In this Privacy Policy, we explain for what purposes we collect and may use your data, how we process them, with whom we share them as well as how to contact us in order to exercise your rights as a data subject.

Data Collection and Use:

All personal information relating to visitors to the B16 website or those who fill in online forms is processed in accordance with the General Data Protection Regulation.

When filling in forms, the communication of your personal data is optional and voluntary.

However, in certain forms the information marked with an * is compulsory. Failure to provide information marked as mandatory will result in the impossibility of analysing the information for the purposes of filling in the form and consequently the impossibility of providing the information or services requested, as applicable.

The data collected will be used for the purpose for which they had been collected and as authorised by the respective data subject.

The data may also be used, with the express consent of the data subjects, to contact them with information related to the reason for processing the data, which may or may not be of a commercial nature, as well as to carry out data subject quality and satisfaction surveys.

We provide data subjects with control over how their data are used. The data subjects hold the rights granted to them by law, specifically the right of access, rectification, deletion and restriction of processing.

The data will be kept and used for the purposes for which they were processed until the data subjects request otherwise.

Marketing Communication and Third Parties:

Data will only be processed with the consent of the data subject, provided when filling in forms or registration forms. If you consent, you may receive marketing communications via e-mail and SMS (if applicable). Consent to the processing of personal data for direct marketing purposes may be revoked at any time.

None of the personal data processed will be made available to third parties, free of charge or for a fee, including direct marketing companies or other entities that use mailing lists to publicise their own products and/or services.

Safety and Liability:

Minors under the age of 18 must obtain authorisation from their parents or guardians before making personal data available on the “B16” website.

Despite the protection measures in place, sending personal information via the Internet always involves the risk of interception and use by third parties. By linking to other websites from this website, whether by means of a link or a banner, “B16” is not responsible for the security and privacy policy, form, content or practices of those websites.

When filling in and sending forms, in addition to the information requested in the form regarding personal contact details, the system may also record the IP, date, time and communication service provider and browser.

Data subject rights:

Data subjects have control over the use of their data, including rights of access, rectification, deletion and limitation of processing. After deleting personal data, some information may be retained for management and statistical purposes, in accordance with the General Data Protection Regulation (GDPR).

The data subject can request this at any time:

Access to information held by B16 that concerns them (A);

The rectification of incorrect or incomplete data (B);

The deletion or limitation of the processing of their personal data (C and D);

In the case of automated data processing, being sent  the personal data provided in a structured manner and in a computer-readable format.

Requests will be handled with particular care to ensure the effectiveness of your rights, and it is sometimes necessary for us to request proof of identity.

In certain cases, the request may not be met immediately, and you will be informed of the measures taken within a maximum of one month.

You also have the right to lodge a complaint with the National Data Protection Commission.

A.  Right of Access

Data subjects have the right to obtain from “B16” confirmation as to whether or not data concerning them are being processed and, where appropriate, to access their personal data and access the information provided for by law.

If you want more than one copy of your personal data being processed, “B16” may charge a fee for the administrative costs.

B. Right to rectification

Data subjects have the right to obtain from “B16”, promptly and without undue delay, the rectification of inaccurate or incomplete data concerning them.

C. Right to deletion

Data subjects may request “B16” to delete their data without undue delay, and “B16” is obliged to delete personal data where applicable, especially in the following cases:

(a) the personal data are no longer necessary for the purpose for which they were collected or processed;

b) The data subject has withdrawn his/ her consent to the processing of the data (in cases where processing is based on consent) and there is no other basis for such processing;

c) The data subject opposes the processing, and there are no overriding legitimate interests justifying the processing;

D. Right to restriction of processing

Data subjects have the right to obtain from “B16” the restriction of data processing if, in particular, one of the following situations applies:

a) To contest the accuracy of the personal data, for a period enabling “B16” to verify its accuracy;

b) The data processing is lawful and the data subject opposes the deletion of their personal data and requests, in return, the restriction of their use;

c) “B16” no longer needs the personal data for processing purposes, but these data are required by the data subject for the purposes of declaring, exercising or defending a right in legal proceedings;

d) A data subject has objected to the processing until it is established that the legitimate grounds of the controller prevail over those of the data subject.

E. Right to object

In cases where data processing is carried out for the purposes of the legitimate interests pursued by “B16”, or for direct marketing, or in the definition and creation of profiles, data subjects may object at any time to the processing of their personal data.

Can I withdraw my consent later?

If consent is legally required for the processing of personal data, the data subject has the right to withdraw consent at any time. However, the withdrawal of consent does not affect the lawfulness of the processing carried out on the basis of the consent previously given, nor the subsequent processing of the same data on another legal basis, such as the fulfilment of the contract or legal obligation to which “B16” is subject.

How does “B16” use cookies and similar technology?
